Corporate Law
Richard represents financial institutions, title insurance companies, and individuals in the state and federal courts in Virginia, Maryland and the District of Columbia. His areas of practice include creditors’ rights, title insurance defense, appellate practice and will and fiduciary matters. Richard is the firm’s President, a Shareholder and a member of its Board of Directors. Richard’s experience includes the defense of mechanic’s liens and the representation of financial institutions and landlords in a variety of lending transactions and workouts, including foreclosures, collections, bankruptcies, evictions and curing defects in land titles. A past president of the George Mason University School of Law Alumni Association, Richard also served as tribune of the Delta Theta Phi Law Fraternity and as an officer and/or director of numerous non-profit organizations. Richard holds an undergraduate degree from the College of William and Mary in Virginia, and law degrees from the George Mason University School of Law, where he was a Justice of the Moot Court Board, and the George Washington University National Law Center, where he received his Master of Laws degree in International and Comparative Law. He has written on the subject of corporate law, lectured on the subject of curing title defects in Virginia and is an Adjunct Professor of Law at the George Mason University School of Law where he recently taught Commercial Paper.
Business Disputes
The firm’s business law practice represents clients in Virginia, Maryland and the District of Columbia. Our attorneys advise clients on which type of business entity best meets the client’s needs. We then prepare the documents necessary to establish the entity, govern the operations of the entity and assist the client in launching the business entity. For established business entities, the firm provides general legal services and advice, litigation services, assistance with contract negotiation and review and general counsel services.
Business Transactions
BHL is intimately familiar with the lending industry. Consequently our lawyers possess the legal experience and skills to offer counsel with respect to a wide variety of issues relating to sophisticated commercial transactions, including the purchase and sale of business enterprises of all types and commercial real estate. This involves the application of expertise to the drafting of commercial instruments such as Lending / Credit Agreements, Purchase Agreements and/or Lease agreements. BHL is involved from negotiating the term sheet to drafting sale documents for both public and private companies.

Real Estate Litigation
A large portion of Barry’s practice has been devoted to representing real estate builders and developers from the land acquisition and planning stage through delivery of finished product. He has also been actively involved in contract and settlement negotiations of all types. He practices extensively in commercial and residential real estate law, including landlord/tenant matters, real estate finance and the formation of condominium and homeowners’ associations. In addition to his significant bankruptcy practice experience Barry has represented several area banks and has served as general counsel to a local bank since 1991.

Foreclosure
This BHL Bulletin is to advise you that the Consumer Financial Protection Bureau (“CFPB”) in Washington, D.C., has issued a final rule with Amendments to the 2013 Mortgage Rules under the Equal Credit Opportunity Act (Regulation B), Real Estate Settlement Procedures Act (Regulation X), and the Truth in Lending Act (Regulation Z) which revise some of the agency’s rules issued in January 2013 establishing national mortgaging servicing standards. The effective date of these changes is either January 1, 2014, or January 14, 2014. Of particular interest is the modification to the interpretation of the 120-day rule found in § 1024.41(f)(1). The amendments explain what actions constitute the “first notice or filing” for purposes of the general ban on proceeding to foreclosure before a borrower is 120 days delinquent, and provide exemptions from the 120-day prohibition for foreclosures for certain reasons other than nonpayment, as explained in further detail below.
