Unfair Competition
Business litigation often involves allegations that a competitor engaged in unfair competition or business tactics designed to injure the plaintiff's business. Such cases will only be successful, however, if the defendant business has crossed the line between legitimate competitive activity and tortious conduct. Not all aggressive competition will be deemed unfair or unlawful; a competitor pursuing its legitimate business interests will generally be permitted to do so without incurring liability. However, when a business or an individual intentionally interferes with your contractual or other business relationship and successfully breaks up the relationship, causing financial loss, liability can arise under a cause of action knows as "tortious interference." (That's tortious, not tortuous). This common law tort strikes a balance between two competing public policies: the promotion of healthy economic competition and the protection of existing or reasonably certain prospective economic relationships.

Employment Discrimination
Age discrimination claims are also on the rise in Virginia and across the United States. The Age Discrimination in Employment Act helps protect older workers in the workplace. This federal law prohibits employers from discriminating against their older workers and from using age as a negative factor in deciding which employees to lay off in the event of a restructuring or reduction in force. Unfortunately, it is quite common for companies to target older, more senior employees for termination because of their higher salaries. Many courts have emphatically rejected these business practices in which the plain intent and effect is to eliminate more expensive older workers in favor of retaining their younger counterparts with lower salaries.

Non-compete Agreement
It is essential for both employees and employers to consult an experienced non-compete lawyer in Virginia because there is no "one size fits all" formula for enforceability. A non-compete agreement may be reasonable (and therefore enforceable) in one context yet unreasonable in another. The inquiry is fact-specific and each situation is different. Consumer litigation focuses on the rights of individual consumers and may involve claims relating to unfair and deceptive trade practices, credit cards, privacy issues, insurance coverage, lemon laws, car fraud, car warranty, fair debt collection practices, vehicle repossession, truth in lending, and other disputes under state and federal consumer protection laws. The protections for the consumer stem from both common law and statutory schemes. This unfolding area of the law has evolved in response to the unfortunate way many large corporations have decided to treat their customers. Consumers often need competent legal counsel to stand up to abuse by massive companies concerned only with making a profit. Sometimes a common-law fraud claim will provide a sufficient remedy to consumer fraud, but Virginia has a more powerful weapon to combat fraudulent business practices in the Virginia Consumer Protection Act. The VCPA, which is designed to promote fair and ethical business behavior when dealing with consumers, allows for the recovery of treble damages (in cases of willful violations) and reimbursement of attorneys' fees, greatly expanding on the potential damages award when compared with common law remedies. It prohibits numerous types of unfair business practices, including fraudulent misrepresentation, false advertising, and many other forms of consumer deception.
