My name is Michael Wilenchik, email address- michael_wilenchik@hotmail.com - I was recommended to Midgley in 2002 to represent me in my divorce. The retainer was $5000 (possibly even $8000 as I don't remember) + additional charges. I would have been better off representing myself! He proposed a "non-modifiable" spousal maintenance agreement. That means even if both my legs were amputated, I would still be bound to a monthly payment that was absolutely rediculous. He never hired a vocational expert to predict what my earnings capabilities were so I went and agreed to a spousal maintenance amount that I can't even earn for myself, let alone being able to make the payment + pay my own expenses.. Then he hires someone to do a "drive-by" real estate appraisal thus not appraising $175,000 of upgrades in my home and back yard. He never did an appraisal of the personal property and the guessed amount fell far short of the actual amount! Yes- I know in the end we are all responsible for our decisions, but going through a divorce is a nightmare and when you are paying an attorney $200+ per hour you rely on them to protect you. What a mess Scott Midgley put me into, and after all is said and done, there was no reason for me to end up in this situation except for the fact that I made the wrong choice for a divorce attorney.
