Big Lots

Have been trying to cancel autorenewal since October of 2008. Called and spoke with a staff member and was told he would take care of it. I asked if I needed to provide written notice as the contract stated and he told me "no, it is taken care of". Fast forward to January 19, 2009. Guess what?? Account still in effect and has now renewed, with continued bank account debits continuing, despite the fact the contract doesn't expire until February 4, 2009. Of course, ABC Financial referred me back to Source fitness to get the automatic billing stopped. Called back to Source and spoke with Lonnie who told me I have to talk with the manager Mike who will be available on 1/20. Called to speak with Mike and was told by him to call ABC to get account closed. Called ABC again and was told again I have to go through Source to get the account closed and to speak with Mike. Drove 40 miles to Source to speak with Mike and file a written notice to close the account as instruced by ABC. On the way called Source and spoke with Edward. Edward didn't know of a form to fill out to close the account and said Mike would be in the gym in about 40 minutes.



Arrived at the gym. No Mike. Waited until 3:20p.m. (approx 30 minutes) . Mike finally arrived and came from working out to assist me. He looked up my account and told me I had not paid my year yet. ABC says I have paid the contract in full and this matches my bank drafts, too. Mike insists I have to pay February before the account can be closed, but concedes he will call them because, "it's only $15". He then told me to call back the next day at the same time. I pointed out it was only 3:30p.m. and asked if ABC's offices were closed (I knew they were not because they are in Arkansas in my time zone). He told me no, but that he is working out right now. I asked again why he could not make the call and if I could fill out the cancellation form. He told me, " I said I'm working out. I'll call them later. Call back tomorrow at this same time and it will be done." He refused to take care of it while I was there and provided no paperwork to cancel the account.



On 1/21 at 0900 I called ABC and spoke with Kiera. She told me the account is still open and I needed to contact Source to get them to close it. She finally allowed me to fax a letter stating I do not want them to debit my bank account further. At 6 p.m. I called Source to check on my account. I spoke with Lonnie who looked up the account and told me it is still open. I asked to speak with Mike again and was told he will be in the gym in 30 minutes. I left my number for call back. I'm still waiting for a return call - 9:00 p.m.



Wondering if I'll have to hire an attorney to get this cancelled. :-(
