Spousal Support
The Bankruptcy Court also promotes fairness among the creditors. Sometimes a bankruptcy filing has the effect of ensuring that creditors are treated fairly, at least in accord with the priorities set up in the bankruptcy code. For instance, debts to pay child support and alimony are among those debts given priority under the bankruptcy code. This means that a debtor can, under the law, as well as morally obtain a discharge of other debts in order to maintain the ability to meet his family law obligations such as child support and alimony. A bankruptcy filing also helps right the situation where a creditor is rewarded for being aggressive. The state collection laws encourage a “race to the courthouse” mentality because creditors rights to debtors non-exempt and unpledged assets is determined based upon who obtains and perfects their judgment first. The aggressive creditor is also awarded outside of bankruptcy because often a creditor is able to badger, harass, threaten, browbeat, frighten or browbeat the debtor into payment just to get the creditor off his back. The filing of a bankruptcy in this situation would not only prevent the aggressive creditor from benefitting from his poor behavior but it will also ensure that reasonable creditors do not get penalized for behaving appropriately. Thus, bankruptcy is a means to help impose fairness not only between the debtor and his or her creditors but also between the creditors themselves.

Personal Injury
These are exceptions to the discharge set out by Congress as so wrongful that debtors do not receive a discharge. Notice that simple inability to repay debt is not included in this list. It is not something to feel guilty about and not likely something that was intended.

Bankruptcy
The truth is that the new bankruptcy law has affected the ability of some Debtors to file bankruptcy under the chapter of their choice because of their income, to the extent that it is not offset by certain expenses and allowances deemed allowable by law. This is called the means test. Where household income falls below the median based upon household size, the Debtor is not required to complete the entire means testing formula and automatically passes the means test. (The Debtor may still choose to file another form of bankruptcy based upon debts assets or other issues.)
Foreclosure
Once a bankruptcy case has been filed, the automatic stay goes into effect and creditors are forbidden from taking most actions to collect their debt. Actions that are forbidden include telephone calls, continuing with lawsuits or collection activities, foreclosures and taking assets for failure to pay a debt.
Tax Law
Mr. Bullington a 1989 graduate, cum laude, of the Mercer University School of Law, received an advanced tax law degree from the University of Florida in 1991, representing an additional year of study after law school dedicated to learning how to assist client in dealing with tax problems. Before joining the Chapter 13 Trustee’s offices Mr.Bullington worked in private practice, gaining experience in dealing with various tax matters, including large estates involving complex tax matters.
