Limited Liability Companies
Use of Cash Method of Accounting: By adopting the cash method of accounting instead of the accrual method, you can generally put yourself in a better position for accelerating deductions and deferring income. There is still time to implement this planning idea, because an automatic change to the cash method can be made by the due date of the return including extensions. The following three types of businesses can make an automatic change to the cash method: (1) small businesses with average annual gross receipts of $1 million or less (even those with inventories that are a material income producing factor); (2) certain C corporations with average annual gross receipts of $5 million or less in which inventories are not a material income producing factor; and (3) certain taxpayers with average annual gross receipts of $10 million or less. Provided inventories are not a material income producing factor, sole proprietors, limited liability companies (LLCs), partnerships, and S corporations can change to the cash method of accounting without regard to their average annual gross receipts.

Estate Planning

Wills
For many people will and trust administration can be a confusing and unfamiliar process. We assist with matters in and out of the court room. In addition to wills and trust we offer these services: Trust Administration, Business Succession Planning, Inheritance Issues, Private Foundations.
Trusts
We provide advice to trustees with regard to the performance of their duties as trustees and their investment, tax, and accounting responsibilities. We assist with the preparation of fiduciary income tax returns and, in the case of revocable living trusts, the preparation of estate and inheritance tax returns upon the death of the trustor. As with estates, we participate in any audit of such returns. We represent trustees with respect to the interpretation of trust provisions and, upon termination of the trust, the distribution of assets to beneficiaries.
Power of Attorney
We assist clients in developing individual financial plans for the management and use of assets during the individual's lifetime. This includes advice regarding legal and tax aspects of joint ownership of property, formation of family limited partnerships and limited liability companies for the management of property and for lifetime transfers to family members; planning for the contingency of disability through "living wills" and advance directives for health care, use of durable powers of attorney and revocable living trusts; and advice regarding various types of investments, the desirability of making gifts and the general effect of income tax laws.

Foreclosure
Discharge of indebtedness on principal residence excluded from gross income of individuals: The exclusion from taxable income of debt forgiven in a foreclosure proceeding or write-down of principal on a mortgage.
