Probate is the legal term for the process by which a court appoints a substitute decision maker for a person and oversees the carrying out of those decisions. Typically, people think of probate as a long, convoluted, and expensive process that must occur when a person dies. The process of managing a person’s estate through the court system (whether or not they have a will) is certainly a significant part of what is considered “probate”. However, probate includes many other matters, as well, including the court-involved creation, modification, and termination of trusts, the establishments of guardianships and conservatorships, and other “protective proceedings” authorized by Oregon statutes.

Social Security Disability
Elder Law typically refers to the planning associated with the need for long term care. This often involves Medicaid, Social Security Disability or Supplemental Security Income, and other public benefit programs. Elder Law planning also often includes dealing with long term health care insurance. Typically our clients will have a spouse or loved one who is currently in need of long term health care, or who will be in need of long term health care in the foreseeable future. Seeking out available benefits, protecting assets and spending down for Medicaid, and working with long term health care insurance benefits are common in this practice. Our goal as Elder Law attorneys is to assist our clients to obtain the necessary benefits for their loved ones, while protecting sufficient assets to allow them to support themselves.
Medicaid Planning
Cinda M. Conroyd received her law degree from Willamette University in 1984, and has been with the firm since 1991. Her practice emphasizes elder law, particularly as it relates to Medicaid planning. Ms. Conroyd first developed her expertise in the Medicaid area while employed as an Assistant Attorney General for the State of Oregon from January 1987 to February 1990 where she represented Senior and People with Disabilities, the State agency which implements the Medicaid program for the elderly and disabled. Prior to working for the Attorney General’s Office, Ms. Conroyd was employed for three years at the law firm of Spears, Lubersky, Campbell, and Young (now Lane, Powell, Spears, Lubersky).

Monica graduated from Willamette University College of Law in 2006. She immediately joined the firm, now Douglas, Conroyd, Gibb & Pacheco, P.C., where she is a partner. Monica’s practice concentrates on estate planning and elder law, particularly as it relates to Medicaid, VA, and disability planning.

A special needs trust provides a way for a person with a disability to receive financial support while remaining eligible for needs-based government benefits like Medicaid or Supplemental Security Income (SSI). We work with families to provide relevant trusts to protect assets, and explain how a special needs trust preserves SSI and Medicaid eligibility, as well as advising trustees on administration and some potential problems that may arise.
Power of Attorney
Estate planning is a broad subject, which is best summed up as the process of “making decisions now for those times when a person cannot make them for themselves in the future.” Proper estate planning typically includes much more than just the traditional Will. A complete estate plan includes a Durable General Power of Attorney and an Advance Directive for Health Care, to ensure that a person’s wishes can be carried out if they become unable to make their own decisions while they are still alive. A complete plan will also include a will or trust that directs the handling of a person’s estate after they pass away.

Debt Collection
One area of Ryan E. Gibb’s practice is the protection of creditors’ rights. This includes debt collection, enforcing judgments, and preserving the rights of creditors in the bankruptcy process. Mr. Gibb is a member of the American Collector’s Association, and is specifically authorized to perform Collection Notice Reviews for debt collectors. Mr. Gibb currently represents two collection agencies, as well as medical providers, contractors, and a variety of other creditors.
