Guardianship
Good financial and health care power of attorney documents are worth their weight in gold. These documents are what are necessary to be able to access your financial assets if you are in the hospital, sick, or have lost capacity (i.e. Alzheimer’s), as well as who can talk to the doctors or hospital on your behalf when you can no longer do so on your own. I frequently tell clients that I redo 85%+ of the financial power of attorneys that I review because they are not sufficiently broad in their powers, particularly if long term care planning becomes desirable in the future. Unfortunately, I’ve also had to tell families that because proper power of attorneys were not previously done, it will be necessary to seek guardianship/conservatorship over their spouse/parent who is now incapacitated. This is the process of going to Court and having someone’s normal adult rights stripped away from them, so that someone else can take over. The problem is that getting a guardianship/conservatorship means that the Court will be overseeing the individual’s life, which can be quite burdensome on the family and that process by itself costs more than an entire estate plan.

Limited Liability Companies
Unfortunately, our society continues to become more and more litigious. Most personal injury or malpractice attorneys will advise clients that no matter how strong a case may appear, you never know what will happen if you actually get in front of a jury. Because of the unknown, most lawsuits are settled prior to actual trial. Proper asset protection planning is designed to force early settlements, for lower dollar amounts in the unfortunate event of some action that leads to a lawsuit. Some of the tools that are frequently used are Irrevocable Trusts, Limited Liability Companies, and Family Limited Partnerships.

Personal Injury
A Special Needs Trust can help to protect your disabled loved one from potential creditors, but also other people who might try to take advantage of your loved one. For example, if your loved one is ever sued in a personal injury action, the assets in the trust would be unavailable for legal claims. Furthermore, because the funds in the Special Needs Trust have no bearing upon government benefit eligibility, your savings can be applied to necessary supplemental expenditures that ensure a higher quality of life for your loved one, while still maintaining control over where any unused money goes at the death of the beneficiary.

Social Security Disability
Disabled – There are two different ways that a veteran can claim that they are disabled. The first would be to show evidence of some medical condition that would render them 100% disabled, much like (but not exactly) the requirement for someone who is applying for social security disability. This can obviously be burdensome as it will require significant medical evidence to substantiate the disability, but can certainly be done. The second, and more common for elder law attorneys, would be to simply have the veteran be at least 65 years old and there is a presumption of disability.

Wills
An objection to a Will, also known as a “Will contest” is a fairly common occurrence during the probate proceedings and can be incredibly costly to litigate.In order to contest a Will, one has to have legal “standing” to raise objections. This usually occurs when, for example, children are to receive disproportionate shares under the Will, or when distribution schemes change from a prior Will to a later Will. In addition to disputes over the tangible distributions, Will contests can be a quarrel over the person designated to serve as Executor.

With continued budgetary constraints on our state and federal governments, it is becoming more important to have private funds available to supplement public aid. However, almost every program that serves the disabled also has extremely low asset limits (such as Medicaid in Missouri, which requires less than $4,000 (July 2019) of countable assets). The proper drafting and implementation of special needs trusts can be the perfect solution to have private funds available for the disabled beneficiary, while still maintaining eligibility for needed government aid.

Estate tax planning is an area that has diminished in importance over the last several years. This is due to the fact that Congress has raised the estate tax thresholds to over $5,000,000 per person. The reality is that less than 1% of Americans have this type of net worth, or are likely to ever have this much in assets. But for families that are fortunate enough to accumulate this level of wealth, estate tax planning is vitally important. This is because when the estate tax hits, it is a major tax (40%). For many families that have between $10-15,000,000 it is still possible to completely avoid estate taxes. When avoiding is not possible, minimizing the estate taxes due can still save hundreds of thousand of dollars.
