Divorce

Child Support
Oregon has adopted the Uniform Interstate Family Support Act (UIFSA). The UIFSA statutes provide authority under certain circumstances for an Oregon court to exercise jurisdiction (power) over a non-resident to establish a child support order, or to modify or enforce a child support order from another state.
Child Custody and Visitation
There are two kinds of child custody under Oregon law: legal custody and physical custody. Legal custody involves the authority to make important decisions for a child, such as where the child attends school, the kind of health care a child receives, and the type of religious training a child receives. If both parents agree, they may have joint legal (decision making) custody. If one parent objects to a joint custody arrangement, then one parent will be awarded legal custody. If there is a dispute about legal custody, and both parents are equally fit and without significant issues, under Oregon law, the parent who has been primarily responsible for the child’s care will generally be awarded legal custody.

Spousal Support
In some cases, one spouse may have to pay the other spousal support. Under Oregon law, there are three kinds of spousal support: transitional spousal support, maintenance spousal support, and compensatory spousal support. With each type of support, there are many factors that determine the amount and duration of the support.
Legal Separation
A legal separation does not end the marriage. The duration of the separation may be for a fixed period of time, or may be for an unlimited period of time. For the first two years after entry of a separation judgment, either party can seek to convert the separation into a divorce. Generally, legal separations involve the same issues as a divorce, such as property division, support, and custody.
Annulment
An annulment restores the parties to their legal status as if no marriage had ever taken place. There are narrow grounds on which the court will annul a marriage. Some of those grounds include (1) one spouse was legally married to another person as of the date of marriage; (2) consent to the marriage was obtained by fraud; and (3) one or both parties were incapable of understanding that the parties were entering into a marriage. An annulment that takes place shortly after the marriage generally awards each party his or her premarital property. Support and custody issues depend on the facts of the case. An annulment that takes place some time after the marriage generally involves all of the issues parties typically deal with in a divorce.

Restraining Order
Domestic violence is an unfortunate reality for some couples. Under Oregon law, if a family or household member has been a victim of abuse, that person can petition the court for a Family Abuse Prevention Act (FAPA) restraining order. “Abuse” is broadly defined to include actions causing or attempting to cause bodily injury and intentionally, knowingly, or recklessly placing a person in fear of imminent bodily injury.

Tax Law
When you are certain that no possibility of reconciliation exists, then and only then do we move forward. The disputes that you have with your spouse will either be concluded by a written agreement or by the court making the decisions for you and your spouse regarding, among other things, child custody, child visitation, child support, spousal support, property and debt division, tax matters, and attorney fees.
