In every state, the right to bring a personal injury action is governed by the STATUTE OF LIMITATIONS. This means that there is a time limit during which you must file your case. If you fail to bring your case within that time limit, you may be barred forever from doing so. Sometimes, insurance companies string people along until it is too late to bring a case. This is why it is so important to start evaluating a case early with an attorney who knows your rights and who is well trained and well prepared to represent you. In Oklahoma, the general statute for personal injury and wrongful death cases is TWO YEARS. However, in medical cases and product liability cases, the law recognizes those situations where it was not possible for the injured person or their family to know exactly what had happened. So, Oklahoma has what is called “the discovery rule” which allows a case to be brought TWO YEARS FROM WHEN THE PLAINTIFF KNEW OR SHOULD HAVE KNOWN that the loss occurred because of the fault of the defendant. This is a very risky proposition, and we encourage all our clients to be diligent in pursuing their claim regardless of the discovery rule. Every case rises or falls on its own facts.
Traffic Violations
There are many reasons why large trucks pose such a danger to the travelling public. First, the eighteen wheel trucks are so large and so heavy that they cannot be brought to a stop easily. Second, some drivers have bought in to the dangerous practice of speeding. Many truck drivers tend to “overdrive” their headlights. Third, trucking companies expect their loads to be delivered at certain times. This puts pressure upon drivers to act accordingly. The result is driver fatigue which reduces concentration and leads to fatal crashes. Finally, there is the influence of legal as well as illegal drugs, coupled with the use of cell phones and texting. Its evident that our roadways and highways must be approached with caution as we try to share them with truck drivers who are often in a hurry to perform for their companies.
Murder
The Constitution of the United States protects the right of each person to enjoy LIFE, LIBERTY, AND THE PURSUIT OF HAPPINESS. When one person dies due to the carelessness or wrongful conduct of another, the surviving members of the victim’s family can bring an action against the responsible people or companies for “wrongful death”. Such death may have been inflicted negligently, as in a car accident or botched surgery. It may also occur as a result of a deliberate act, such as murder. Either way, the survivors can seek money damages against the party who caused the death. The damages are pursued in a CIVIL action, separate an apart from any CRIMINAL charges that the exemplary or punitive damages might bring. In Oklahoma, the items which make up such damages are spelled out in in the Civil Uniform Jury Instructions as follows...
