Criminal Defense

DUI/DWI
Being arrested and charged with a DWI in New York can be one of the worst experiences of your life. Not only did you have to go through the terrible process of being arrested and forced to take sobriety/breath tests, but you also face losing your license or even worse, jail time.
Traffic Violations
The police will check to see if you are wanted for an arrest or court warrant, summons or unpaid traffic ticket. If there is a warrant, you may have to spend additional time in jail before arraignment while the court locates the paperwork. If the warrant is from a county other than the one in which you are arrested, you may have to remain in jail after the arraignment and be transferred to that county.

Disposition: ALL CHARGES DISMISSED ON 08/03/2021* Another amazing outcome. Client was charged Forcible Touching and Sex Abuse, which the NY County DA’s office takes very seriously- all cases must go through their Sex Crimes Bureau. The client professed his absolute innocence and I concluded that he was being truthful and the evidence bore it out. I drafted and submitted a very substantive memorandum laying out significant detail why the complainant was not being truthful and that the case could not be proved beyond a reasonable doubt. That submission, followed by a “proffer” laid the groundwork for the DA’s office to dismiss all charges. Very, very tough to get the prosecutors to dismiss all charges in a sex case. This was not only a great result, but the right result. Very happy for the client. Innocent people get charged with crimes and to get this result for someone who was is very satisfying.

Just as every client is different and each case has its own unique sets of facts and circumstances, the defense strategy for obtaining the best possible result must also be uniquely tailored for each case. Many cases require a “persuasive” approach- making the prosecutor and the judge realize the humanity of the client and the myriad mitigating circumstances that call out for leniency. Whether it be the wealthy housewife who shoplifts at Saks because she is having a mid-life crises, the young man who commits a robbery to demonstrate his toughness to his friends, the Upper East Side banker who accused of domestic violence, or the twenty-something who sells drugs to an undercover police officer out of complete foolishness, the “persuasive” approach- if handled the right way- can often lead to spectacular results. Indeed, I’ve had cases where the client is caught on video committing a felony dismissed outright by the prosecutor because they were persuaded it was the right thing to do.

If you are charged with a crime (a misdemeanor or felony, as defined by the Penal Law, Vehicle and Traffic Law or New York City Administrative Code), you will be fingerprinted and photographed. If you are charged only with offenses classified as violations (such as disorderly conduct under the Penal Law) you will probably not be fingerprinted. However, if the police are unable to establish your identity, suspect that you are giving false information about your identity, or believe that you are a wanted person, they may take your fingerprints even if you are only charged with a violation.
