If all the issues are decided between the parties they may agree to submit the papers to the court for approval; this is known as an uncontested divorce. When the defendant is served but does not answer the legal pleadings the plaintiff may seek a default judgment by application to the court. If the divorce is started with a Summons with Notice then the grounds will either have to be proven by plaintiff’s affidavit or by testimony at an inquest if the divorce is uncontested or to be granted by default. Uncontested divorces are also granted after the defendant appears and waives the right to answer the complaint. In these cases the defendant neither admits nor denies the plaintiff’s allegations, it is up to the plaintiff to prove the allegations by testimony or affidavit in such a case.

When there are children in a divorce case, issues of custody, visitation, and child support must be worked out before the Judge will sign the Judgment.

There are certain victims of abuse who may be eligible for a green card. Under the Violence Against Women Act (VAWA ) self-petitioners, who are also eligible via the ‘family’ category. A self-petitioner may be male or female and are the abused immediate family members of U.S. citizens, and in some cases, lawful permanent residents (green card holders). ‘Juveniles’ who have been abused and abandoned are given this status via a U.S. Court (normally the family Court). Typically, a juvenile will have gone through a guardianship process, but this status can also be derived from a custody, divorce or other types of hearings. Additionally, victims of abuse under certain government acts, for example, the Cuban Adjustment Act, may also qualify to adjust their status.

Misdemeanors
You were arrested because a police officer who had reason to believe that you had committed a felony, misdemeanor, or violation. If you are charged with a felony, the officer must file a felony complaint in the Criminal Court. If you are charged with a misdemeanor, the officer must file a misdemeanor complaint in the Criminal Court. If you are charged with a violation, you may not have been arrested, but a police officer may have brought you to a police station to give you a desk appearance ticket (D.A.T.). Drug Crimes
Committing an offense or even an ‘admission’ to committing a drug offense, will make you inadmissible to America. However, even if there is a ‘reason to believe’ that you have been trafficking in drugs or financially benefited from trafficking in drugs in any manner, even if such trafficking was done by a spouse or a parent this will also raise the issue of inadmissibility and affect your chances to obtain a visa.

A. Been convicted, or admitted to any drug offense, except a single offense of thirty grams or less of marijuana (it is of no consequence that the possession/use of marijuana has been legalized by some states), or, b. Been convicted or admitted to murder or torture of a person, either in the U.S. or in another country.
