Dear Potential Law Client in a Domestic Violence Case:



I never, in my 57 year life, thought I might ever be a defendant in a misdemeanor domestic violence case.



I work in real estate, had never, ever been arrested for any type of battery, and committed no domestic violence against my wife, an immigrant to the U.S. from Peru.



The latter fact, a learned quickly, was my undoing. Immigration law requires that an immigrant spouse remain in a marriage for two years, to demonstrate that the marriage is real, not simply "arranged" to circumvent U.S. Immigration laws. The only exception is for genuine cases of domestic violence, Congress not wanting immigrants to be forced to remain in a marriage involving domestic violence.



What I learned, way too late, is that immigrants regularly "cry wolf", i.e. domestic violence, in order to get out of a marriage before the two year time requirement. Making a provably false complaint to authorities about domestic violence provides an immigrant spouse -- and this goes both ways on the gender issue, as my next girlfriend had been a victim herself of false accusations years before -- a "deportation-proof" divorce.



Anyway, I soon learned that communication with the State Attorney's Office is essential to proving one's innocence. In fact, I also learned that domestic violence laws have been so toughened -- 3 or 4 separate major overhauls and strengthenings of the domestic violence laws, and additions of Courts, Prosecutors, and other personnel, by the Florida Legislature, in the past 20 years -- that a domestic violence criminal defendant, yes, must virtually prove his or her innocence.



Because Sara Shulevitz had worked for the State Attorney's Office, as a Domestic Violence prosecutor, she was able to help me prove my innocence, and save my business reputation, which ultimately also meant saving my business.



I submit for your consideration that if you genuinely believe you are innocent, only a former prosecutor is likely to be listened to seriously by the present prosecutor in your case. Ms. Shulevitz, therefore, stands out as one of perhaps three defense counsels who can predictably win your case.

I served time In South Carolina on a ten year sentence In 1985 till 1991 for a Major Felony. After moving back to Miami, I caught a Grand Theft Auto charge In 1993, which after making Bail I went back to South Carolina. In 1995 I was arrested once again on a Felony Charge. I served two years and was released. I returned to Miami and was arrested for the 1993 Charge, after a traffic stop. I received 5years Probation. I Then was arrested again for new Grand Theft Auto In 2006. A family member knew a friend that knew one of the best Lawyers in Dade County and was able to get him to take my case Pro;Bono. I was facing 10years but Mr. Don Cohn was able to get me a sentence of 1year and a Day, plus 2years of House Arrest. After completing my prison time and starting my house arrest back at home, I contacted Mr. Cohn about this house arrest situation and he was sad to inform me he could no longer help me, because he had been Elected JUDGE. He then informed me that he was turning over many of his cases to a young Attorney by the name of SARA SHULEVITZ. I knew she must be a really good Lawyer If a man who just became a Judge was telling me she was who I needed. I contacted her the next day and she took my case. She worked out a payment plan for me and began working at once on my case. Ms. SHULEVITZ was able to get me in front of JUDGE PRESCOTT within a matter of weeks. The State of Florida was not very happy when Ms. SHULEVITZ was able to get the Judge to agree to change the 18months left on house arrest to regular Probation. After completing the probation, I once again had to rely on Ms.SHULEVITZ. After having cleared my cases, I was arrested 2009 for GRAND THEFT AUTO. I tried to make bail but was not able to because they held me on probation violation which I had already completed. Ms. SHULEVITZ came to the jail and told me to give her some time to get all this mess straighted out. I really do not know how she did it all, but within 2weeks I had a NO ACTION AND NO PROBATION PAPER IN MY HAD, I was released that night from the DADE COUNTY JAIL. A MONTH LATER I RECEIVED A LETTER OF CLEMENCY FROM THE STATE OF FLORIDA. I OWE ALL THIS TO A REALLY HARD WORKING AND PROFESSIONAL LAWYER BY THE NAME OF MS. SARA SHULEVITZ
