Child Support
In most cases, your wages cannot be garnished out of the blue without your knowledge. Your creditor must first file a lawsuit against you for the debt owed. However, there are exceptions to this rule if you owe child support, student loans or income taxes. In these instances, your wages may be garnished without a lawsuit.
Guardianship
If you have minor children, it is essential to develop an estate plan that names a guardian to care for your children in the event of your incapacitation or death. In addition to designating a guardian, many parents create a trust to provide financial support for their children until they reach a certain age. The guardian could also serve as contingent trustee.
Spousal Support
There are several types of nondischargeable debt. Money owed to the government for taxes or student loans are typically not eligible for elimination. Child support and alimony arrearages and other court-ordered payments must also be made.

DUI/DWI
There are some debts that are not dischargeable. These include most student loans, child support and alimony obligations, and debts resulting from drunk driving accident judgements or settlements, among others.
