The law firm was recommended to my family when I was going through a very difficult, stressful situation - my first arrest ever - DWI. Ms. Nicole Bellina helped and counseled me through my legal proceedings. She showed compassion, legal expertise/experience and drive handling my case. She was able to downgrade my misdemeanor charge to an infraction when I finally complete a prescribed program and had a NYS DMV Chemical Test Refusal appearance case closed due to probable cause for arrest not established. A client was accused of burglarizing an apartment. The occupant’s neighbor, watching through a peephole, called 911 as the front door to the apartment opposite was jimmied open. The client was stopped by police on the next stair landing down, holding a “fanny pack” containing the occupant’s jewelry. The neighbor identified the client as the person he had seen jimmying open the door. The client faced 15 to life if convicted of a felony, due to his prior record. The jury returned a verdict of not guilty on all but a misdemeanor count of possession of stolen property, and the client was sentenced to just time served.

Severance Agreement
Shake it off, get up, and start swinging for your life. You’re not going to salvage your job, but you can salvage your reputation and self-respect, and secure a reasonable severance package. Severance is not a right, but it is a very common benefit conferred by most companies in the event of a layoff, restructuring or termination for cause. And as much as an employer may insist that severance pay is based on a standard formula, our experience suggests otherwise – it is a benefit that varies based on many different factors, not the least of which is the preparedness, poise and aggression of the outgoing employee. Understand that employers often intentionally offer no severance or a smaller amount than they are prepared to pay knowing that you may retain a lawyer and attempt to negotiate for more. All too frequently, employees leave money on the table by failing to recognize this, or by attempting to negotiate without a lawyer when their employer has little incentive. Also, employees with potential legal claims are more likely to get more severance pay, and many if not most terminated employees are not even aware that they have legal claims and leverage in a severance negotiation.
Sexual Harassment
Gender discrimination involves any adverse action taken by a company because of the gender of an employee, whether it’s failing to pay the same wages as men, failing to promote women or terminating women. Some industries tend to attract these claims, particularly the financial industry, but gender discrimination can be found in any industry. Sexual harassment takes one of two forms: quid pro quo or hostile work environment. Quid pro quo harassment result when a subordinate rebuffs the sexual advances of a supervisor or manager, while hostile work environment claims involve the emotional distress caused by a workplace polluted with sexist language, stereotyping, one-sided preference for employees of a single gender, or physical groping and touching. Sexual harassment claims can only be brought if the workplace is truly polluted with this conduct, and if the person bringing the claim was actually offended by the behavior. The New York City Human Rights Law provides for individual liability with respect to supervisors or managers who participated in, condoned or failed to remedy discriminatory behavior by their subordinates. Lawsuits involving individually named employees often settle because companies do not want to subject their officers to the distraction of litigation and the risk of a judgment for damages against individual employees.

Personal Injury
A native New Yorker, Nicholas graduated from Boston University, cum laude, in 2005 and from the University of Connecticut School of Law, with honors, in 2008. As a law student Nicholas received awards for his performance in several legal writing, moot court, and mock trial competitions. Prior to joining Stoll, Glickman and Bellina, Nicholas worked for a firm focused on insurance litigation, where he gained extensive personal injury trial experience.
Disability Discrimination
Despite this, employment of the disabled is at a low point and has not improved despite the bipartisan efforts of Congress to remedy disability discrimination in passing the Americans with Disabilities Act (ADA) over a decade ago, as well as the Family and Medical Leave Act (FMLA) which requires employers to provide 12 weeks of unpaid leave for a serious medical condition. Unlike other forms of discrimination, legislative efforts to address disability discrimination have been addressed with broad bipartisan support, including the ADA Amendments Act which strengthened protections for the disabled in the workplace. Yet the disabled continue to be refused employment, terminated, harassed and denied reasonable accommodations.
