Dissolving a marriage involves the court implementing court orders regarding the equitable distribution of marital property, the payment of spousal support (alimony) and child support, and the division of child custody, including both physical custody and legal custody.
Child Custody and Visitation
Although New York was the last state in the nation to allow for “no-fault divorces,” for more than a decade now New Yorkers have been able to divorce based on an allegation that the marriage has suffered an irretrievable breakdown. Obtaining a divorce might be simpler now that fault grounds such as adultery or “cruel and inhuman treatment” don’t have to be proven, but it is still essential to have excellent legal representation in your divorce. New York only recognizes economic damages, so family members cannot recover for their emotional pain and suffering. However, they can recover for the conscious pain and suffering experienced by the decedent between the time of injury and death.
