Child Support
Child support is the amount of money that a non-custodial parent (parent with whom the child/children do not reside) pays to the custodial parent (parent with whom the child/children reside) for the basic daily care of the child/children. The amount to be paid is based on a formula set forth by the State of New York, known as the Child Support Standards Act. When it comes to child support there are complex and extremely nuanced issues which our firm can help with. Paternity
Absent an Acknowledgement of Paternity, establishing paternity can be accomplished by filing a petition in Family Court. From the mother’s legal perspective, she needs to establish paternity in order to seek child support. From the father’s perspective, he needs to establish paternity to have a legally recognized right to have a relationship with the child. Of course, under both circumstances come rights but also responsibilities. Once a father is legally established for the child, he may be responsible for support until the child attains a certain age or is “emancipated”, but also has the right to seek custody or visitation with the child. If you have had a child with someone who has not been declared the child’s legal father or if you are the father of a child and have not been declared as the child’s legal father, it is essential that you seek timely legal advice with an experienced attorney as there many issues that need to be addressed and understood before you take any action.
Premarital Agreement
Everyone getting married today should enter into prenuptial agreement. No one enters into a marriage believing that it will end in divorce, however, we know that statistically it is something that may unfortunately happen. The prenuptial agreement is a per-marital contract that goes into effect once you are married and can help you and your fiancé resolve certain future financial issues now when you are not in a hostile situation. If you never divorce, then the issue is mute but if the relationship ever dissolves, it can be an invaluable contract to have in place. The prenuptial agreement gives you and your fiancé the freedom to decide your financial future without having to have a Judge decide for you in the future.
Spousal Support
Spousal support, also referred to as “maintenance” or “alimony,” is financial support paid by one spouse to the other during and after a separation or divorce. A petition for spousal support can be filed in Family Court, even if there is no divorce proceeding pending in Supreme Court. If there is a divorce case pending in Supreme Court, then the Supreme Court, which is a court of higher jurisdiction, can determine the issue of spousal support along with all the other issues pertaining to the divorce.
Legal Separation
For a variety of reasons, many people choose to remain legally married but to live apart from each other. There are two ways that you can accomplish this legally. One way is to enter into a Separation Agreement, which is a comprehensive contract amicably addressing all the issues between you, such as custody, parenting time, child support, spousal support, division of marital assets, etc. The second way is to file for a legal separation, which is a contested action, and have a Judge issue a Judgment of Separation. The pros/cons and the nuances of each are something that we can discuss with you to ensure that you make a wise and informed decision regarding your best interests.
Annulment
Under certain circumstances, it is possible to end a marriage through an annulment. Instead of being “divorced,” it will be as though the marriage never happened because the marriage was “void” or “invalid” from the start.
