Degree Air Conditioning & Heating responds to complaint ID 9376150 filed by Sandra Griffiths as follows:



1. Sandra Griffiths has never at any time provided to Degree an estimate from any registered contractor indicating that the cost to repair Degree’s alleged non-compliant building code installation will cost $2,100.00.

2. Sandra Griffiths has refused to answer Degree’s telephone calls, but then makes the allegation that the caller ID for Degree’s phone number appears as “out of area”. Degree’s caller ID is not blocked and lists the business’ phone number in caller ID. If someone has called her telephone who is “out of area”, how does she falsely claim that it is Degree who is calling her if she refuses to answer the telephone? Degree’s employees are professionals who act accordingly.

3. Sandra Griffiths declares that someone from Degree arrived without appointment and that they reeked of alcohol. She seems to say that she refused to open the door so how could she detect the smell of alcohol through a closed door? Her allegation is another figment of her imagination.

4. Sandra Griffiths makes general references to violations of ADA and other laws, but makes no reference to any specific provision of any law. The Americans With Disabilities Act (ADA), appears to be altogether inapplicable. Title I prohibits disability discrimination in employment; Title II prohibits State and local governments from discriminating against individuals on the basis of disability; Title III prohibits such discrimination in public accommodations and commercial facilities, such as hotels, restaurants, and doctor’s offices; and Title IV requires telephone companies to provide telecommunications relay services for individuals with hearing and/or speech disabilities. No sections of the ADA are applicable to commercial transactions.

5. No response has been necessary by legal counsel to Sandra Griffiths as each of her letters is merely repetitive of her prior correspondence, with the exception that the only new allegation which now appears in the latest complaint to the BBB is that an unnamed registered contractor has estimated the cost to repair the alleged errors in Degree’s installation at $2,100, and she provides no evidence of any truth to this claim.

6. Sandra Griffiths’ statement to the BBB misstates the name of Degree’s attorney;

7. Sandra Griffiths’ statement to the BBB declares that her Certified Mail addressed to Degree’s attorney was signed for by “Mark Tarwater himself on Monday January 28, 2013". This statement is absolutely false on two counts:

There is no Mark Tarwater who is legal counsel for Degree; and

Mack Tarwater (the correct name of legal counsel) did not sign personally for any Certified Mail. It can therefore be safely assumed that her other allegations are fabrications;

8. Degree has used reasonable efforts to comply with the complaints of Sandra Griffiths. Sandra Griffiths has unreasonably denied access to Degree and Degree has been unable to inspect and correct any alleged errors;

9. Degree has acted appropriately under the circumstances and performed professionally. The complaints of Sandra Griffiths are unfounded and should be dismissed without further consideration.

Worst Experience!!! Horrible to deal with to get issues corrected DEGREE is Unprofessional & Rude-, DISHONEST & Deceptive- 8 Months later AC/Heat Still Does Not Work .Refused admit mistakes- I paid $260.0 for Two Independent ROC Licensed Contractors’ Inspections and the Better Business Bureau’s Air Conditioning Industry Advisory Committee (ACIAC), which has reached the following conclusion:



Based on the information that was available, it was determined the business did fail to properly install the unit. Furthermore, Degree Air Conditioning & Heating caused additional damage to the drywall and paint, pull down attic ladder, and personal property.

Degree REFUSES to Refund my Money $85000.00 and Pay for the Property Damages of $5400.00.

First things first, I am Severely Visually Impaired and a Senior Citizen- I cannot see to read the written contracts so I had to rely on DEGREE’s Verbal Agreements. I had them read out loud the papers which they DID NOT READ correctly, Falsely informing me of what I was paying for and what I received!

** I had NO HEAT the coldest winter in Arizona

** Cannot Run AC since the Drip Pan is not installed correctly and can cause my ceiling to cave in from water damage.

** DEGREE is a PRICE GOUGER- Charged 600 Percent Mark-up on Parts. DID NOT Honor Advertised Senior and Cash Discounts – Did not give CONTRATED discount for Maintain ace Agreement PMA repairs and Did NOT perform Seasonal Tune-Up THIS PMA cost $500.00 for 3 years! Charged me $200.00 three for one $39.00 Thermostat!

** DEGREE refused to fix their errors: Improper installation not to code -Air Exchange in Attic Incorrectly Installed, Drain Pan not properly seated- Only One Drain – requires two drains-Values Installed Incorrectly, Thermostats Not Wired- Connected a 50 amp unit to a 22 AMP Fuse box- a FIRE HAZZARD –

- Breeched Contract did not install parts they were paid for!
