While a revocable living trust may avoid probate, there is still much legal work that is necessary after a death. The tasks involved are often beyond the ability and resources of the successor trustee. The assistance of legal counsel can save thousands of dollars and countless hours of frustration and confusion.
Power of Attorney
A proper estate plan, of course, includes a revocable trust, which contains all the terms for incapacity and post-death planning, as well as a pour over will, which simply says, â€œMy name is, Iâ€™m married to, my children are, and I leave everything I have them to my trust,â€ so that if probate administration is necessary at the end of the probate administration will have an order from the court ordering distribution of the assets to the trust for eventual distribution. We need another standby document as well, and that would be a durable special power of attorney. The durable special power of attorney would give our agents the ability to engage in any acts that we could while we were alive and well to put assets into the trust.
Probate
After earning his Juris Doctor degree in 1974 from Michigan State University College of Law, Jeffrey decided he wanted to help individuals and families plan for their futures. He moved to California where he continues to provide estate services as an author, educator, and certified specialist in Estate Planning, Trust, and Probate Law.

Tax Law
Well, with the tax changes that have occurred over recent years and the compression of the estate tax rate down to 40% on a federal basis, and on a federal basis, the highest income tax rate being 39.6, theyâ€™re pretty much the same. So, we can spend more time on income tax planning than we have to on estate tax planning. With our exemptions of $5.49 million per person, thereâ€™s probably only one to two percent of the entire US population that has to concern itself with estate tax. We may still have concerns about gift tax, but gift tax really only supports the income tax. So, income tax planning has really become the new estate tax planning.
