An attorney, expert in handling gang cases, will make every effort to limit gang testimony and use every effort to cross-examine the expert to show that he is unqualified and bases his opinions on speculation and not fact. Even the best lawyer cannot anticipate how a case will resolve. The decision is made by judges and juries - people whom you have never met before and do not know what kind of person you are. Many good young people wind up in tragic situations simply because they are ignorant to the principle of situational avoidance. What is situational avoidance? The ability to foresee a situation that has the potential of becoming disastrous and avoiding it.

Law enforcement, prosecutors and judges can be overzealous in their pursuit. I once had a case where the husband and wife got in an argument at a store over Christmas shopping. They screamed at each other, and the husband took a cab home. An onlooker called the police who followed the wife home and interviewed the wife. The wife confirmed that her husband was mildly bipolar but had never exhibited any violence toward her or her two children. When the husband arrived in the cab, he was arrested and booked and issued a restraining order to stay away from the family home. The case was later dropped based upon statements and testimony from the wife attesting to the fact that the entire incident was blown out of proportion.

The problem was â€“ HOW DO YOU WRITE A BAD CHECK TO YOURSELF??? The case was dismissed three times at the preliminary hearing. The District attorney handling the case just did not get it!! I could have made a case if I had been the prosecutor after years representing banks as well as companies involved in commercial transactions, but I certainly was not going to educate my opponent while the case was pending. Eventually, we resolved the case in civil court and paid the bank back its money. No criminal case was ever charged.
