Child Abuse
Larry handled substantially all depositions and the majority of trial preparation in a case against the State of Hawaii in which its employees failed to comply with their obligations as "mandated reporters" regarding instances of known or suspected child abuse. The case settled before trial for approximately $5 million.

Wrongful Death

Assault
Under Hawaii law, the estate of a deceased person may recover damages for wrongful death - i.e. loss of life due to the wrongdoing of others - whether it is due to negligent, reckless, or intentional conduct. A wrongful death may occur due to a motor vehicle/automobile accident, a defective product, medical negligence, a work-related accident, a commercial recreational accident, assault and battery, and so on.

Employment Discrimination

Severance Agreement
When you and your employer have agreed that you will be separating from employment, i.e. severing your employment with your employer, often times, a severance agreement / severance package will be prepared for your review and signature. The severance agreement contains the terms and conditions of your severance / separation. The most common terms are an agreement / promise by the employee to never pursue any legal claims against the employer for any events or actions that arose during the period of employment, and in exchange, the employer promises to pay the employee a specified amount of money as a severance pay. Severance packages are not required by law, but in some cases, when you have a contract setting forth the terms and conditions of your employment, if the contract requires that a severance package be offered in the events of separation / severance from employment, the employer will likely be obligated to follow the terms of the contract when offering you a severance package.
Sexual Harassment
Under Federal Law and Hawaii Law, it is an unlawful employment practice for an employer to discriminate against any individual with respect to the terms, conditions, or privileges of his or her employment because of the individual's race, color, religion, gender/sex, sexual orientation, national origin, medical condition or medical disability. In other words, an employer can not make decisions related to the hiring or firing of an employee based on the employee's race, color, religion, gender/sex, sexual orientation, national origin, medical condition, or medical disability. Sexual harassment is a form of sex/gender discrimination and it is unlawful under Federal Law and Hawaii Law.

Premises Liability
Larry handled virtually all pretrial discovery and the great majority of trial presentation, including the great majority of witness examinations and closing argument, in the lawsuit against the State of Hawaii for the May 9, 1999 rock fall disaster at Sacred Falls State Park. The trial resulted in a liability verdict for the plaintiffs and ultimately resulted in a $6.8 million settlement for the plaintiffs.

Personal Injury
Upon his return to Hawaii from law school, Larry became a law clerk to the Honorable Philip T. Chun, Chief Judge of the civil division of the State of Hawaii, First Circuit Court. In 1988, after a one-year clerkship, Larry became an associate at the law firm of Gill Park Park & Kim. In January 1994 Larry became a partner in the firm, which was then known as Park Kim Yu & Remillard and later became known as Park Park & Remillard. In his 22 years at Park Park & Remillard, Larry focused on the successful representation of plaintiffs in a wide range of personal injury and related cases. On January 1, 2011, Larry and Don Huynh, his former associate of six years, formed the law firm, Remillard Huynh & Barbour.
