Usually the local government has a zoning administrator who is responsible for enforcing the regulations. Estate Planning
In recent years the practice of promoting and selling so-called “revocable living trusts” has become quite an extensive and lucrative practice. Legal services companies, financial advisors, and some lawyers aggressively advertise and promote these trusts. In our practice and experience, we have seen many instances of individuals and couples being victimized by these promoters and the trust packages they sell. A trust is certainly a valid and useful means of estate planning. However, the mass-marketed trust packages are dangerous and ill-advised. Do not purchase an estate plan from someone that conducts a seminar at a local hotel.
Wills
The word, “probate,” literally means to prove. The phrase, “probate the will,” generally means to file and present a last will and testament to the court. Some counties in Tennessee have a dedicated Probate Court and in others probate matters are handled by the Chancery Court. In a few counties the General Sessions Court has probate jurisdiction.
Trusts
Special needs trust: These trusts allow mentally or physically disabled people to inherit assets and still remain eligible for government benefits, such as Medicaid and Supplemental Security Income (SSI).
Power of Attorney
No, there are several kinds of financial powers of attorney. They can take effect immediately (an immediate POA) or only upon the grantor being declared disabled by their doctor (a springing POA). Also a POA can be as broad or as narrow as the grantor desires.
