Wrongful Death
Wrongful death occurs when a victim is killed as the result of negligence or other unlawful or unjust action by another. Generally, wrongful death consists of four elements: (1) death was caused, in whole or in part, by the conduct of the defendant; (2) the defendant was negligent or strictly liable for the death of the victim; (3) there is a surviving spouse, children, beneficiaries and/or dependents of the victim; and (4) monetary damages have resulted from the victim’s death.
Traffic Violations
Despite the general causes of typical collisions, such as speeding or failure to pay attention to the road, some common causes of multi-collision wrecks may be attributed to the following: poor visibility; poor weather conditions; motorists driving closely behind other motorists; wrong way drivers; and obstructions on the road. There have been several accounts in the national news where a sudden onset of fog or extremely heavy downpour of rain severely limited the ability of motorists to see the road or other vehicles in the distance and contributed to multi-vehicle collisions. In fact, there was one instance of a paper manufacturing factory in Tennessee that had a history of frequent fog production due to its manufacturing processes. This factory was located near a highway that was in a low lying area. On one particularly occasion, the fog developed and and enveloped the highway causing death and injury to more than 50 motorists.
Sex Crimes
The term "premises" includes unimproved property (land) and improved property (including without limitation buildings/homes/offices/apartments/RV homes/parks). In Georgia, the owner or possessor of the premises owes a duty of care to a person that is an invitee, licensee and/or trespasser. The failure of such duty leads to a premises liability injury or damage. Examples of premises liability include without limitation the following: slips on wet floors; trips on uneven pavement/floor/carpet; falls on property; inadequate lighting indoors/outdoors; negligent security; assault/battery/rape on premises; falling objects; inadequate security on premises and defects in chairs/tables/benches.
Misdemeanors
In Georgia, the conduct of a hit and run driver who fails to stop and provide identifying information is a crime under O.C.G.A. 40-6-270. Under Georgia law, a motorist that causes injury to or the death of another person, or property damage to a vehicle, is under the following obligations: 1) stop or immediately return to the scene and identify himself providing the registration information of his/her vehicle; 2) provide his driver’s license information upon the request of a victim or other motorist; 3) render aid and transportation (or arrange transportation) if it is obvious that transportation is required for treatment or the victim requests transportation; and 4) contact EMS and police if the victim is deceased, unconscious or unable to communicate. If the accident causes serious injury or death and the motorist fails to stop, then the motorist may be found guilty of a felony and imprisoned for one to five years. If the injury is not serious and causes property damage, then the crime is considered a misdemeanor.

A hit and run auto collision occurs when a motorist causes or contributes to a collision (to a fixture, person or other vehicle) and fails to stop and give his/her name. In the early days, hit and run drivers that fled the scene of a collision were almost impossible to identify because there were no license plates, drivers typically wore goggles, which obstructed their appearance, and unpaved roads created dust that hindered the vision of the victim. However, nowadays--and almost uniformly across the United States--a driver that flees the scene of a collision and fails to stop and identify himself is a violation of the law.

The prosecution of a car accident can best be explained in the following manner: an existing duty, a breach of that duty, and resulting damages. In Georgia, a driver has a duty to operate a vehicle according to the rules of the road. For example, a driver should not follow too closely behind another vehicle. That is a legal duty of a motorist under O.C.G.A. 40-6-49. For example, when a driver breaches this duty by following too closely, a rear end collision occurs. The collision causes two types of damages: bodily injury and property damage (and perhaps diminished value to the car). To prove that the other driver was negligent, we must show the insurance company and the jury that the other driver had a duty to operate the car safely, breached that duty, and caused irreparable harm and damage to another.
